Privacy Policy

THIS PRIVACY POLICY DESCRIBES HOW SEYGOV, A PRODUCT OF NASSAU TECHNOLOGIES LLC ("SEYGOV," "WE," "US," OR "OUR"), COLLECTS, USES, STORES, SHARES, AND PROTECTS INFORMATION IN CONNECTION WITH THE SEYGOV PLATFORM AND RELATED SERVICES ("SERVICES"). BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS POLICY, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SERVICES. This Privacy Policy applies to: (a) government agencies, organizations, and entities that subscribe to and use the Services ("Subscribers"); (b) authorized users acting on behalf of Subscribers; (c) members of the public who interact with applications deployed by Subscribers through the Services; and (d) any other individual or entity who visits the Seygov website or accesses any Seygov-hosted content.

1. Scope and Applicability

This Privacy Policy applies to the Seygov website, platform, hosted applications, APIs, and all related services provided by Seygov. This Privacy Policy does not apply to: (a) systems, servers, applications, or platforms operated independently by government agencies, Subscribers, or third parties, even if integrated with the Services; (b) third-party websites or services linked to from the Seygov platform; or (c) data processed by Subscribers within their own environments using Subscriber-controlled infrastructure. Seygov is not responsible for the privacy practices of Subscribers, their deployed applications, or any third-party systems connected to the Services. Subscribers are solely responsible for their own privacy practices, notices, and compliance obligations with respect to their constituents and members of the public.

2. Information We Collect

Seygov collects information in the following categories:

Account and Registration Information: When a Subscriber registers for the Services, Seygov collects information such as organization name, contact name, email address, domain information, government type, address, and billing information. This information is collected directly from the Subscriber and is necessary to establish and maintain the account.

Configuration and Usage Data: Seygov collects data related to how Subscribers configure and use the Services, including application settings, deployed application parameters, feature usage, system logs, access timestamps, IP addresses, and browser or device information. This information is used to operate, maintain, secure, and improve the Services.

Subscriber Data: Data submitted to or generated through the Services by Subscribers, their authorized users, or members of the public who interact with Subscriber-deployed applications ("Subscriber Data") is processed by Seygov solely on behalf of the Subscriber and for the purpose of providing the Services. Seygov does not claim ownership of Subscriber Data and does not use Subscriber Data for any purpose other than providing the Services, except as required by law.

Public User Data: When members of the public submit information through a Subscriber's deployed application, that data is collected and stored as Subscriber Data. Seygov processes this data solely as a service provider on behalf of the Subscriber. The Subscriber — not Seygov — is responsible for all notices, disclosures, and legal compliance obligations with respect to data collected from members of the public through Subscriber-deployed applications.

Website Visitor Data: When you visit the Seygov website, we may collect standard web server log information such as your IP address, browser type, referring URL, and pages visited. This information is used for security monitoring, analytics, and platform improvement purposes.

Communications Data: If you contact Seygov via email, web form, or other means, we retain records of that communication for customer support and internal record-keeping purposes.

3. How We Use Information

Seygov uses the information it collects for the following purposes: (a) to create, manage, and maintain Subscriber accounts; (b) to provide, operate, and improve the Services; (c) to process payments and manage billing; (d) to communicate with Subscribers regarding their accounts, service updates, maintenance notices, security alerts, and other service-related information; (e) to detect, investigate, and prevent fraudulent activity, security incidents, and misuse of the Services; (f) to enforce these Terms and Conditions and this Privacy Policy; (g) to comply with applicable legal obligations; and (h) to analyze aggregate, anonymized usage trends to improve the Services. SEYGOV DOES NOT SELL, RENT, TRADE, OR OTHERWISE TRANSFER SUBSCRIBER DATA OR PERSONAL INFORMATION TO ANY THIRD PARTY FOR MARKETING, ADVERTISING, OR ANY OTHER COMMERCIAL PURPOSE.

4. Subscriber Responsibility for Public-Facing Data Collection

SEYGOV EXPRESSLY DISCLAIMS ALL RESPONSIBILITY FOR THE PRIVACY PRACTICES OF SUBSCRIBERS WITH RESPECT TO MEMBERS OF THE PUBLIC. When a Subscriber deploys a public-facing application through the Services that collects information from members of the public, the Subscriber is solely and exclusively responsible for: (a) providing all required privacy notices and disclosures to members of the public in compliance with applicable law; (b) obtaining any required consents from members of the public prior to collecting their information; (c) complying with all applicable privacy laws, data protection regulations, freedom of information laws, and government records requirements; (d) responding to any access, correction, deletion, or other data subject requests from members of the public; (e) implementing appropriate safeguards for the protection of data collected from members of the public; and (f) any and all legal claims, regulatory actions, fines, or penalties arising from the Subscriber's collection, use, storage, or disclosure of information from members of the public. Seygov's role is limited to that of a technology service provider processing data on behalf of the Subscriber. Members of the public interacting with Subscriber-deployed applications should direct any privacy-related inquiries to the applicable Subscriber organization, not to Seygov.

5. Authentication, Integrations, and Third-Party Systems

Subscribers may connect their own identity providers, LDAP servers, SMTP servers, payment processors, and other third-party systems to the Services. When such integrations are configured, data may be exchanged between the Services and those third-party systems. SEYGOV IS NOT RESPONSIBLE FOR THE PRIVACY PRACTICES, SECURITY, AVAILABILITY, OR DATA HANDLING OF ANY THIRD-PARTY SYSTEM INTEGRATED WITH THE SERVICES. Credentials, authentication tokens, and configuration data provided by Subscribers for integration purposes are stored securely and used solely for the purpose of enabling the configured integration. Seygov does not independently authenticate end users outside of the integration methods configured by the Subscriber.

6. Data Sharing and Disclosure

Seygov does not share, sell, rent, or trade Subscriber Data or personal information with third parties except in the following limited circumstances: (a) Service Providers: Seygov may engage third-party service providers who perform functions necessary to operate the Services, such as hosting providers, payment processors, and infrastructure vendors. These service providers are contractually limited to using information only for the purpose of providing services to Seygov and are prohibited from using such information for their own purposes; (b) Legal Requirements: Seygov may disclose information if required to do so by applicable law, regulation, legal process, or governmental request, including but not limited to court orders, subpoenas, or law enforcement requests; (c) Protection of Rights: Seygov may disclose information where necessary to protect the rights, property, or safety of Seygov, its users, or others, or to detect, prevent, or address fraud, security incidents, or technical issues; (d) Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or substantially all of Seygov's assets, Subscriber Data may be transferred to the acquiring entity, subject to the same privacy protections described in this Policy; and (e) Subscriber Direction: Seygov may share data as directed by the Subscriber in writing. Except as described above, Seygov will not disclose Subscriber Data to any third party without the Subscriber's prior written consent.

7. Data Retention and Deletion

Seygov retains Subscriber Data for as long as the Subscriber's account is active and for a reasonable period following termination of the account to facilitate data retrieval requests, subject to Seygov's operational and legal requirements. SEYGOV MAKES NO GUARANTEE REGARDING THE AVAILABILITY OF SUBSCRIBER DATA FOLLOWING ACCOUNT TERMINATION AND RESERVES THE RIGHT TO PERMANENTLY DELETE SUBSCRIBER DATA FOLLOWING A REASONABLE RETENTION PERIOD AT SEYGOV'S SOLE DISCRETION AND WITHOUT FURTHER NOTICE. Data backup and restoration are performed at Seygov's discretion and on Seygov's own schedule for internal operational purposes only. Seygov is not obligated to provide data backups or exports on demand or within any specific timeframe. Subscribers are solely responsible for exporting and maintaining their own independent copies of all Subscriber Data prior to account termination. Website visitor data and usage logs may be retained for security monitoring and analytics purposes for a period determined by Seygov at its sole discretion.

8. Security

Seygov implements reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction. These measures include but are not limited to encrypted data transmission, access controls, authentication requirements, and regular security monitoring. HOWEVER, NO SECURITY MEASURE IS COMPLETELY IMPENETRABLE OR FOOLPROOF, AND SEYGOV DOES NOT WARRANT OR GUARANTEE THAT INFORMATION WILL BE PROTECTED FROM ALL UNAUTHORIZED ACCESS, DATA BREACHES, CYBERATTACKS, OR OTHER SECURITY INCIDENTS. SEYGOV SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CONSEQUENCES ARISING FROM ANY SECURITY INCIDENT, DATA BREACH, OR UNAUTHORIZED ACCESS TO SUBSCRIBER DATA OR PERSONAL INFORMATION, WHETHER RESULTING FROM SEYGOV'S OWN SYSTEMS OR FROM THE ACTIONS OF THIRD PARTIES. Subscribers are responsible for maintaining the security of their own credentials, systems, and third-party integrations. Any suspected security incident should be reported to Seygov immediately through the contact methods provided on the Seygov website.

9. Cookies and Tracking Technologies

The Seygov website and platform may use cookies, session tokens, and similar technologies that are strictly necessary for the operation of the Services, including authentication, session management, and security functions. Seygov does not use cookies or tracking technologies for advertising, behavioral profiling, or cross-site tracking purposes. By using the Services, you consent to the use of strictly necessary cookies and session technologies as described in this section. You may configure your browser to reject cookies; however, doing so may impair the functionality of the Services. Seygov does not respond to browser "Do Not Track" signals at this time, as no uniform standard for such signals has been established.

10. Children's Privacy

The Services are not directed to children under the age of 13, and Seygov does not knowingly collect personal information from children under 13 through the Seygov platform or website. If a Subscriber deploys an application that may collect information from minors, the Subscriber is solely responsible for ensuring compliance with all applicable laws governing the collection of information from minors, including but not limited to the Children's Online Privacy Protection Act (COPPA). Seygov disclaims all responsibility for Subscriber compliance with laws applicable to the collection of information from minors.

11. Your Rights and Choices

Subscribers may access, update, or request deletion of their account information by contacting Seygov through the methods provided on the Seygov website. Members of the public who have submitted information through a Subscriber-deployed application should direct any access, correction, or deletion requests to the applicable Subscriber organization, as Seygov processes such data solely on behalf of the Subscriber and does not independently fulfill data subject requests from members of the public. Seygov will cooperate with Subscribers in responding to verified data subject requests to the extent technically feasible and required by applicable law. Certain information may be exempt from deletion or modification where retention is required by applicable law or is necessary for legitimate operational purposes.

12. Third-Party Links and Content

The Seygov website or platform may contain links to third-party websites, resources, or services. These links are provided for convenience only. Seygov has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party website or service. Accessing third-party links from the Seygov platform is done at your own risk, and Seygov encourages you to review the privacy policies of any third-party sites you visit.

13. Changes to This Privacy Policy

Seygov reserves the right to update, modify, or replace this Privacy Policy at any time at its sole discretion. When changes are made, the revised Privacy Policy will be posted to this page with an updated effective date. YOUR CONTINUED USE OF THE SERVICES FOLLOWING THE POSTING OF AN UPDATED PRIVACY POLICY CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO THE REVISED POLICY. It is your responsibility to review this Privacy Policy periodically. If you do not agree to the updated Privacy Policy, you must discontinue use of the Services.

14. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of the United States and the laws of the state in which Nassau Technologies LLC is incorporated, without regard to conflict of law principles. Any disputes arising out of or relating to this Privacy Policy shall be resolved in accordance with the dispute resolution provisions set forth in Seygov's Terms and Conditions.

15. Contact Information

Seygov will make reasonable efforts to respond to inquiries in a timely manner but does not guarantee any specific response time. Members of the public with privacy inquiries related to a specific government agency's deployed application should contact that agency directly.
